PUBLIC AGREEMENT FOR SERVICE PROVISION
VIA THE YOYO APPLICATION
1. Subject of Regulation
1.1. This Public Agreement for Service Provision via the YoYo Application of "Fast Shift" Limited Liability Company (hereinafter: the Agreement) establishes the terms for opening, topping up, and using a Registration Account in the YoYo mobile application for the use of electronic payment instruments within the electronic money settlement system of "Fast Shift" LLC (hereinafter: the Company).
1.2. In accordance with the Civil Code of the Republic of Armenia, this Agreement constitutes an official written public offer (hereinafter: the Offer) by "Fast Shift" LLC for the use of its declared services, addressed to natural persons.
2. General Provisions
2.1. The Offer may be submitted online or by another method established by the Company.
2.2. By accepting the Offer, the User (Family Member) confirms that they have fully reviewed and unconditionally accept all terms of the Agreement without exception, the rules for using the services, and the applicable fees — the current versions of which are posted on the Company's official website and/or presented in the YoYo mobile application.
2.3. Information about the types of services, methods of provision, possible operations, timeframes, and applicable commissions is published on the Company's official website; commission information is also communicated prior to each transaction.
2.4. The Family Member bears responsibility for any operation performed through the Registration Account opened in the YoYo mobile application.
2.5. The Company provides automated self-service to Users on a 24/7 basis. Actions defined in the Agreement that are not automated are carried out by the Company on working days and hours as defined by its internal regulations, which are published on the official website and/or in the YoYo mobile application.
2.6. Settlements in the electronic money system are made in Armenian Drams (AMD).
2.7. One (1) unit of issued electronic money equals one (1) Armenian Dram.
3. Key Definitions
3.1. The definitions used in the Company's public agreement for electronic money services apply equally to this Offer, unless otherwise specified herein.
3.2. User — a natural person who has not reached the age of majority under the laws of the Republic of Armenia.
3.3. User Registration — opening (registering) a Registration Account in the System under the User's name.
3.4. Services — the following services available in the YoYo mobile application:
- 3.4.1. QR payments
- 3.4.2. Mobile phone account top-up
- 3.4.3. Receiving funds exclusively from family members
- 3.4.4. Transferring funds exclusively to family members
- 3.4.5. Requesting funds exclusively from family members
- 3.4.6. Payment for device rental from mobile phone charging stations
- 3.4.7. Ability to invite friends to the YoYo mobile application
3.5. YoYo Mobile Application — software developed by the Company for mobile devices, through which Account management and use of Services are accessible under the terms set by the Offer.
3.6. Family Member — the User's legal representative: father, mother, sister, brother, or guardian.
4. Conclusion (Acceptance) and Duration of the Agreement
4.1. Acceptance of the Agreement is deemed to occur upon the identification of the User by the Family Member.
4.2. Acceptance of the Agreement means full and unconditional acceptance of all terms without any exceptions or limitations, and is equivalent to a written contract.
4.3. Acceptance of the Agreement is not subject to a time limit.
4.4. All notifications under the Agreement are made electronically — via email, the Company's official website, the mobile application, or SMS — and are considered proper notification.
5. Opening a Registration Account and Identification
5.1. To open (register) a Registration Account in the YoYo mobile application:
- 5.1.1. The User (Family Member) enters their phone number, to which the Company sends a one-time confirmation code.
- 5.1.2. If an incorrect phone number was entered and no code was received, the User repeats the registration process to receive a new code.
- 5.1.3. After entering the confirmation code, the User (Family Member) creates a password (PIN code).
5.2. After registration per clause 5.1:
- 5.2.1. A unique, non-repeating Registration Account ID is assigned.
- 5.2.2. A QR code is generated for the Family Member to identify the User.
5.3. To identify the User, the Family Member:
- 5.3.1. Scans the QR code generated per clause 5.2 using their Fast Shift mobile application.
- 5.3.2. Specifies which family member they are.
- 5.3.3. Provides the User's: (a) first and last name, (b) gender, (c) date of birth.
- 5.3.4. Enters the birth certificate number.
- 5.3.5. Uploads a photo of the birth certificate.
- 5.3.6. Provides the name and address of the User's school.
- 5.3.7. Confirms the entered information.
6. Use of the Registration Account
6.1. The User uses the Services defined in this Offer.
6.2. The balance in the User's Registration Account may not exceed 1,000,000 (one million) AMD at any time.
6.3. The maximum limit per single transaction is 100,000 (one hundred thousand) AMD.
6.4. The Family Member receives a notification for each of the User's transactions.
6.5. The User (Family Member) creates their own login credentials and may change the password at any time and any number of times.
6.6. The User (Family Member) bears full responsibility for maintaining the confidentiality of their login credentials. Any action performed using valid credentials is considered to have been performed by the User, except as provided by Armenian law.
6.7. In the event of loss of login credentials, the Company allows the User (Family Member) to restore access by entering a recovery code sent to the email address linked to the account, the registered mobile phone number, or via another communication channel, upon instruction from the User (Family Member).
6.8. A payment instruction sent to the Company using the User's (Family Member's) login credentials is sufficient to identify the User (Family Member).
6.9. The User (Family Member) may unilaterally terminate the Agreement and close their Account at any time by submitting a request using their identification credentials to the Company's official email address ([email protected]).
6.10. The Agreement is terminated and the Account is closed in the manner and within the timeframes established by the Company's internal regulations.
7. Other Terms
7.1. The rights and obligations, complaint handling procedures, and privacy terms established in the Company's public agreement for electronic money services apply equally to this Offer, unless otherwise specified herein.
7.2. For failure or improper performance of obligations under this Agreement, the Company and the Family Member bear liability as prescribed by Armenian law.
7.3. The Company is not liable for failure to timely notify the User (Family Member) due to disruptions in postal, internet, or other communication services beyond its control, or due to changes in the User's (Family Member's) contact information.
7.4. The Company is not liable for failure to fulfill its obligations due to communication, power supply, or other technical failures.
7.5. The Company is not liable for transactions made by third parties through the Registration Account, or for disclosure of identification or login credentials, if this occurred as a result of interception or data theft during Account use.
7.6. The Company is not liable if the Account management credentials are disclosed to or lost to third parties.
7.7. If the Family Member suspects that Account credentials may have become known to third parties due to loss or change, they are obligated to immediately notify the Company in the prescribed manner. Until the credentials are blocked or changed, the Family Member bears the risks of unauthorized use, including liability for damages to the Company.
7.8. The Company and the Family Member are released from liability for partial or full non-performance of their obligations if caused by force majeure circumstances — fire, flood, earthquake, communication or power failures, and other circumstances beyond their control, including System disruptions due to communication failures beyond the Company's control, as well as decisions, rulings, or other legal acts of RA state authorities that hinder fulfillment of obligations under this Agreement.
7.9. The User's Family Member guarantees that:
- 7.9.1. The terms of the Agreement are understood and fully and unconditionally accepted.
- 7.9.2. The User's Account will not be used for illegal activities.
7.10. This Agreement is governed and interpreted in accordance with the legislation of the Republic of Armenia.
